1) Acceptance of Terms

By accessing thecadworx.com or engaging any CADWorx service ("Services"), you agree to these Terms of Use ("Terms").

2) Scope of Services; No Professional Practice

CADWorx provides CAD drafting and related coordination support (e.g., 24-Hour Redlines, Test-Fits, As-Builts). We are not a licensed architecture or engineering firm. Our deliverables are for coordination and documentation support only and must be reviewed/approved by a licensed design professional prior to permit or construction. We do not provide professional seals, sign-and-seal services, or official jurisdictional approvals.

3) Client Responsibilities

You will (a) provide accurate information and timely access to files, (b) ensure you have rights to all content you supply, and (c) engage a licensed design professional to review/approve final documents before any official use, submittal, or construction. You remain responsible for compliance with all laws, codes, and authority-having-jurisdiction (AHJ) requirements.

4) Quotes, Pricing, Payments

Some offerings (e.g., 24-Hour Redlines) have flat pricing paid via Stripe. Payment is due at order unless otherwise agreed in writing. Applicable taxes/fees may apply.

5) Turnaround & Scheduling

"24-Hour" references apply to typical small to mid-size packages (≈10 sheets or fewer) with complete inputs and clear scope. Larger, incomplete, or complex projects may require additional time. We will communicate if estimated timelines change. Delays caused by third parties or late inputs may extend turnaround.

6) Deliverables & License

Upon full payment, we grant you a non-exclusive license to use our drafting deliverables internally for the specific project. Your supplied materials remain yours; you grant us a limited license to use them solely to perform the Services. Unless you opt out in writing, we may reference non-confidential project details (name, general scope) in our portfolio.

7) Changes, Revisions, and Refunds

Fixed-fee rush offerings are generally non-refundable once work begins. Material scope changes or new information may require additional fees upon your approval.

8) Confidentiality

We will keep your non-public project information confidential and use it only to perform the Services, except as required by law or with your permission.

9) Third-Party Services

You may be subject to third-party terms (e.g., Stripe, Calendly, Google Drive/Dropbox). CADWorx is not responsible for third-party platforms.

10) Disclaimers; No Warranty; No Approvals

THE SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CADWORX DOES NOT WARRANT THAT ANY DELIVERABLE WILL OBTAIN PERMIT APPROVAL OR MEET ALL AHJ REQUIREMENTS WITHOUT FURTHER REVISION BY YOUR LICENSED PROFESSIONAL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

11) Errors & Omissions; Limited Liability Insurance

While we exercise reasonable care, drafting work can involve errors and omissions. You agree to promptly review deliverables and notify us of issues so we can address them. CADWorx maintains limited liability/business insurance appropriate for our operations; this clause does not expand our liability beyond Section 12.

12) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CADWORX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF USE; OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO CADWORX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT.

13) Indemnification

You agree to indemnify and hold CADWorx harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from (a) your content or instructions, (b) your use or misuse of the Services, or (c) your violation of laws or third-party rights.

14) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to internet/hosting outages, labor disputes, epidemics, or natural disasters.

15) Governing Law; Venue

These Terms are governed by the laws of the State of Florida (without regard to conflicts rules). Exclusive venue lies in Duval County, Florida.

16) Changes to Terms

We may update these Terms; the "Last updated" date reflects the current version. Continued use after changes constitutes acceptance.
